Regulations of thee newsletter

These Regulations define the necessary information regarding the Newsletter service provision.

I.          Definition of

The terms used in the Regulations mean:

  1. Business days - days of the week from Monday to Friday excluding public holidays.
  2. Consumer - a consumer within the meaning of Article 22[1] of the Civil Code.
  3. Newsletter - a free service provided by the Store to the User, consisting of sending electronic correspondence containing, among other things, educational content, information about events organized by the Store, as well as commercial information, directed to the e-mail address provided by the User.
  4. Entrepreneur - an entrepreneur within the meaning of Article 43 [1] of the Civil Code.
  5. Entrepreneur on the rights of a consumer - a Customer who is a natural person concluding an Agreement directly related to his/her business activity, when the content of this Agreement shows that it does not have a professional character for him/her, arising in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.
  6. Regulations - this document.
  7. Online Store/Store - an online store in the domain www.sislo.pl, through which the Seller sells Products and provides Services electronically in accordance with the Regulations.
  8. Service - a service provided electronically by the Seller to the Customer in accordance with the provisions of the Act on Provision of Electronic Services.
  9. Consumer Rights Act - the Act of May 30, 2014 on consumer rights (Journal of Laws 2014, No. 827 as amended).
  10. Act on Providing Services by Electronic Means - the Act of July 18, 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, Item 1204 as amended).
  11. User - an individual, legal entity or organizational unit without legal personality, but with legal capacity, who intends to conclude or has concluded an agreement for the Newsletter service.

II.          General provisions

  1. The Regulations define the detailed conditions for providing the Newsletter service. The Regulations are continuously available on the website of the Store in a manner that allows its reproduction, acquisition and consolidation of its content by saving it on a carrier at any time.
  2. The minimum technical requirements to use the Online Store are:
    1. computer or mobile device with access to the Internet,
    2. standard software and operating system,
    3. web browser Chrome version 114 or later, Firefox 113 or later, Opera version 100m or later or Safari version 15 or later,
    4. Javascript enabled in the browser
    5. active email account.
  3. The Store informs that the public nature of the Internet and the use of services provided electronically may involve risks for any Internet user, consisting in the acquisition and modification of user data by unauthorized persons and the introduction of harmful software into the user's ICT system. In order to avoid the risks mentioned in the previous sentence, customers should use appropriate technical measures to minimize the indicated risks, in particular, they should use anti-virus programs.

III.          Newsletter

  1. The Store allows the User to conclude a contract for the provision of electronic services in the form of a Newsletter.
  2. In order to conclude a contract for the Newsletter service, the User fills in an electronic form available on the Store's website, or sends an appropriate request to the Store's e-mail address.
  3. A message requesting confirmation of the Newsletter subscription will be sent to the User at the e-mail address provided by the User. The Newsletter service contract is concluded upon effective confirmation of subscription by confirming the e-mail address in accordance with the content of the message sent.
  4. The Newsletter provides educational content, as well as information about new blog posts or discounts, current promotions, bonuses and other marketing and commercial information about products and services offered by the Store.
  5. The contract for the Account Service is concluded for an indefinite period of time and is terminated when the Customer sends a request to delete the Account.
  6. Newsletter service is provided free of charge. A user who does not wish to provide his/her personal data for the delivery of digital content may receive it in exchange for payment of a price specified by the Store. For this purpose, the user should contact the Store at the e-mail address - [email protected].

IV.         Liability for conformity of digital content with the contract, withdrawal from the contract and complaint

  1. The store undertakes to provide digital content and services to the user in accordance with the contract. Conformity is assessed according to the criteria indicated in the Consumer Rights Act.
  2. The store shall be liable for the lack of conformity with the contract of digital content delivered at one time or in parts, which existed at the time of delivery and became apparent within two years from that time and also delivered continuously, which occurred or became apparent at the time when, according to the contract, they were to be delivered.
  3. The store recognizes the request and informs on the manner of its resolution within 14 days by sending a response to the customer by e-mail, and in the absence of this address, by regular mail. Lack of response within this period means recognition of the User's request as justified.
  4. The User who is a Consumer or Entrepreneur on the rights of a Consumer has the possibility to withdraw from the Newsletter service contract within 14 days without giving any reason.
  5. Complaints, statements of withdrawal or incompatibility of digital content mentioned above can be reported:

  6. In the complaint, the Customer should provide his name, surname, mailing address and a description of the irregularities that occurred.
  7. In case of deficiencies in the complaint, the Seller may call on the Customer to supplement the complaint to the necessary extent, indicated by the Seller immediately, but no later than within 7 days of receipt of the call by the Customer.

V.                 Copyright

  1. All materials and content made available to the User are the intellectual property of the Store and constitute a work within the meaning of the Copyright Act.
  2. The materials are made available to the User for his/her own use. It is forbidden to use the materials in any other way, including, above all, their distribution.

VI.       Out-of-court ways of dealing with complaints and redress of grievances

The customer who is a Consumer has the following options for out-of-court means of handling complaints and claims:

  1. Is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Contract;
  2. is entitled to apply to the provincial inspector of the Commercial Inspection with a request to initiate mediation proceedings for the amicable settlement of a dispute between the Customer and the Seller;
  3. may obtain free assistance in resolving a dispute between the Customer and the Vendor, also using the free assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include the protection of consumers (such as the Federation of Consumers, the Association of Polish Consumers). Advice is provided by the Federation of Consumers at the toll-free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address [email protected];
  4. file your complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.

VII.                 Personal data protection

The Seller processes Customers' personal data in accordance with applicable laws and the rules set forth in the Privacy Policy.

VIII.                 Final provisions 

  1. The seller reserves the right to make changes to the Terms and Conditions for important reasons, which include, in particular:
    1. introduction of new or change of existing services,
    2. change of technology or development of the Store,
    3. change of the law, which will make it necessary to change the provisions of the Terms and Conditions.
  2. The Seller will inform customers of changes to the Terms and Conditions by posting appropriate information on the Store's home page.
